APPRAISING THE INHIBITORY FACTORS TO ACCESS INFORMATION AND THE COURT UNDER THE NIGERIAN COMMUNICATIONS COMMISSION ACT

Abstract

The right to access information and the courts in Nigeria is constitutionally guaranteed. Access to information and the courts in Nigeria is, however, faced with certain inhibitory factors as enshrined in the Nigerian Communications Commission Act. The law lays down a herculean and restrictive administrative procedure that limits access to the courts. The NCC Act provides that any person aggrieved by its decision may request a statement of the reasons for the decision. This is contrary to the provisions of the Freedom of Information Act. The doctrinal method was adopted in this research by considering available statutes and literature on the subject matter. The paper recommended that the legislative arm of government should not enact laws that promote impunity and abuse of power by public officers, authorities, and statutory corporations.
