Abstract

This study undertakes a critical examination of the Patients' Bill of Rights in Nigeria, with a focus on the legal, ethical, and socio-legal challenges that have hindered its effective implementation. Despite its lofty provisions, the Patients' Bill of Rights has failed to deliver on its promises, leaving patients vulnerable to abuse and neglect. The research identifies the Nigerian factor as a significant contributor to this failure, characterized by a complex interplay of socio- cultural, economic, and institutional factors. These factors have conspired to undermine the effectiveness of the Patients' Bill of Rights, rendering it ineffective in protecting the rights of patients in Nigeria. Through a comprehensive analysis of the legal, ethical, and socio-legal landscape of Nigeria's healthcare system, this study proposes recommendations to address the challenges facing the Patients' Bill of Rights. These recommendations are designed to ensure the protection of patients' rights in Nigeria, promote accountability and transparency in the healthcare system, and ultimately improve the quality of healthcare services in Nigeria.
